  1. 1. ELIGIBILITY: Dufresne Furniture & Appliances’ “Your #DufresneStyle Giveaway” (the “Giveaway”) is open to legal residents of Manitoba, Saskatchewan, and Ontario, who are of legal age of majority in their jurisdiction of residence at the time of entry. Employees, officers, directors and agents of TDG Furniture Inc. o/a Dufresne Furniture & Appliances (the “Sponsor”), its parent, subsidiaries, affiliates, or advertising and promotion agencies, and their immediate family members (spouse, parents, grandparents, siblings and children, and each of their spouses, regardless of where they live) and persons living in the households of each of these individuals, whether related or not, are ineligible to enter or win. The Giveaway is void in Quebec and where prohibited by law. The Giveaway is subject to all applicable federal, provincial, and local laws. No purchase is required in order to enter or win the Giveaway.
  2. ENTRY PERIODS AND DRAWS:

Entries will be accepted in accordance with these Official Rules from Friday, April 26, 2019 up to and including Friday, May 10, 2019 inclusive (the “Entry Period”). At the end of the Entry Period, a total of one (1) prize is available to be won, selected by a panel of Dufresne Furniture & Appliances judges, subject to the satisfactory completion by such selected entrant of a skill testing question and declaration of eligibility, such participant drawn shall be declared the winner of the applicable prize in respect of such Entry Period.

  1. HOW TO ENTER: No purchase necessary. Limit one (1) entry per person. Participants can enter the Giveaway by visiting the official Giveaway webpage located at https://www.dufresne.ca/pages/DufresneStyle, and filling out the entry form during the Entry Period by following the instructions found on the official Giveaway webpage. All entries must include your first name, your email address, and a photo submission (the “Submission”).

CONDITIONS OF ENTRY: Notwithstanding anything else contained in these Official Rules:

An Entry for the Giveaway must be received by 11:59 pm Central Time (CST) on the final day of the Entry Period to be eligible for the draw.

There is a limit of one (1) entry per household per day. Any attempt to earn extra entries by using multiple/different identities, contact information, registrations or log-ins, or any other methods, will void all of such participant’s entries and that participant will be disqualified from the Giveaway draw.

All related expenses incurred in connection with entering the Giveaway shall be borne solely by the participant (including the costs of any product or financing contract, postage, computer usage fees and internet usage / data fees).

By entering the Giveaway, participants agree to be bound by the terms of these Official Rules and to the decisions of the Sponsor, which are final and binding.

Participants consent to the collection, use and disclosure by the Sponsor, its affiliates and their respective officers, agents and employees, of their personal information for the purposes of administering the Giveaway, for compiling statistical and consumer habits and market information and, if consented to on the ballot, for contacting the participant with promotional and/or marketing materials. Although participants may be given the option to receive commercial communications from the Sponsor, participation in the Giveaway is not dependent upon the participating agreeing to receive communications, and such agreement will not impact a participant’s chance of winning the Prize.

The photo Submission must adhere to the following terms and conditions:

  1. Be an original creation. Reproducing, modifying, enhancing or altering a third party’s pre-existing work does not qualify as an original creation;
  2. Be in .jpg, or .png format and a maximum file size of 5MB;
  3. Not violate the rights of any third party, including, but not limited to copyright and trademark rights;
  4. Not have been previously published, used commercially, submitted to another competition or contest, or won any other award;
  5. Be in “good taste” and must not be explicit, obscene or offensive, as determined by Dufresne Furniture & Appliances, in its sole and absolute discretion;
  6. Not be likely to tarnish, depreciate or otherwise damage the reputation of the Sponsor;
  7. Not be false, inaccurate or misleading;
  8. Not violate any law or regulation;
  9. Not be libelour, threatening or harassing;
  10. Not instigate others to commit illegal activities or violate human rights; and
  11. Not contain any viruses, worms, or other interfering computer programming.

All photo Submission(s) become property of the Sponsor. By submitting your photo Submission to the Sponsor, you are agreeing to the following:

You grant the Sponsor and any designates, assigns, successors and licensees a non-exclusive, irrevocable, worldwide, transferable, royalty-free, perpetual, unrestricted, sublicensable right to use, market and promote your photo Submission in any manner or media now known or later developed, for any purpose, including without limitation the rights to reproduce, display, publish, perform, translate, transmit, broadcast, modify, adapt, alter, distribute, sell, lease, lend, display, present, commercialize, create derivative works from your photo Submission, and exercise all intellectual property and any other rights with respect to your photo Submission, without any compensation or notice to you or any approval from you, with or without your name (whether your legal name or your user name on the applicable platform), including, without limitation, in advertising and promotion of any of our products and/or services. Without limiting the foregoing, you represent that you have all consents and licenses necessary to use and to authorize us and our designates, assigns, successors and licensees to use your photo Submission in the manner permitted in the Terms. You agree that your photo Submission is not confidential.

You represent and warrant to us as follows: that your photo Submission is your own original work and that you have the right to grant the rights and permissions set forth in the Terms; you have obtained all necessary licenses and permissions from all applicable third parties required for the submission of the photo Submission and use as permitted in the Terms; you are over the age of 18; the posting and/or display and/or other permitted use of your photo Submission by the Sponsor or those deriving rights through the Sponsor will not violate any provision of any applicable law or regulation, or in any way infringe or violate rights of any third parties, including but not limited to copyright and other intellectual property, privacy or other rights; you waive any and all “moral rights” that exist in your photo Submission and any derivative works made therefrom.

You agree that your photo Submission created, submitted or otherwise made available by you to the Sponsor or for the Sponsor will not: be abusive, threatening or harassing towards others; include any infringing, obscene, defamatory, slanderous, libelous, offensive, or illegal content (including without limitation content which violates another person’s right of privacy); include commercial or political solicitations or messages; include any content designed to injure people or property (including without limitation viruses); impersonate others or be misleading as to your identity or the source of your photo Submission; suggest that you or your photo Submission is sponsored or endorsed by us (unless it is); otherwise violate the Terms.

You agree that these Terms are to be considered an agreement made under seal.

  1. SELECTION OF WINNER: Entries received to https://www.dufresne.ca/pages/DufresneStyle during the Entry Period will be selected by a panel of Dufresne Furniture & Appliances judges among all other eligible entries received or entered during such period, to win The Prize, subject to the conditions, and restrictions below. All entries must be received by 11:59PM CST on the final date of the Entry Period to be eligible for the selection. Limit one (1) entry per person/household/address. Odds of winning the Prize will depend on the number of eligible entries received during the Entry Period. The selected entrant will be contacted by email and, in order to be declared the winner, will be required to execute and return a declaration of eligibility within fourteen (14) days of date of the draw (or within such longer period as the Sponsor may in its sole discretion allow) and to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question prior to prize award. If the selected entrant does not return the properly executed documents within the specified time period, is ineligible, fails to correctly answer the skill testing question within the time provided, or cannot or does not comply with these Official Rules, he/she will be disqualified, the Prize will be forfeited and, at Sponsor’s discretion, an alternate entry may be selected from the other entrants for such Prize selection. All entries become the property of the Sponsor and will not be returned. The selection is not merit-based, and entrants will not be selected based on the quality or content of any Letter Entry.
  2. PRIZES: There is a total of one (1) $500.00 CAD Dufresne Furniture & Appliances gift card to be won (the ‘Prize”), drawn from eligible entries submitted between Friday, April 26, 2019 and Friday, May 10, 2019. Winners will be announced on or before Monday, May 20, 2019.
  3. GENERAL PRIZE RESTRICTIONS: All prizes are non-transferable and are not redeemable for cash, in whole or in part. Certain other restrictions may apply. Except as otherwise specified herein, no substitution will be made. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor, and all the Participating Stores’ respective usual terms of sale shall apply to merchandise purchased with the gift certificate awarded. All federal, provincial and local taxes (including income and withholding taxes) and any costs and expenses related to the acceptance and use of a prize not specified herein are the responsibility solely of the prize winner.
  4. GENERAL CONDITIONS: Entrants agree to be bound by the terms of these Official Rules and to the decisions of the Sponsor which are final and binding. By entering a draw, entrants’ consent to the collection, use and disclosure by the Sponsor, its affiliates and their respective officers, agents and employees, of their personal information for the purposes of administering the Giveaway, for compiling statistical and consumer habits and market information and, if consented to on the ballot, for contacting the entrant with promotional and/or marketing materials. Acceptance of a prize constitutes permission for the Sponsor and its designees to use the Prize winner’s name, city of residence and likeness for advertising and promotional purposes in any and all media now or hereafter known without any compensation, notification or permission. Neither the Sponsor, its affiliates, their respective directors, officers or employees nor any other person, shall be responsible for lost, late, illegible, incomplete, inaccurate, misdirected, stolen, undelivered, delayed or damaged entries, or lost or stolen entry boxes nor for mechanical, technical, printing, typographical, human, or other errors relating to or in connection with the Giveaway, including, without limitation, errors or problems which may occur in connection with the administration of the Giveaway, the processing of entries, the announcement of the Prize, the contacting the selected entrant or in any Giveaway-related materials. Sponsor reserves the right to terminate the Giveaway or amend these rules (or any portion thereof) at any time in whole or in part without notice and for any (or no) reason and, if terminated, Sponsor may (but shall not be obligated to), at its discretion, award the Prize for the Entry Period at issue to an entrant drawn from among all eligible, non-suspect entries received during that Entry Period prior to such date of termination, subject to the conditions herein as to the declaration of eligibility and the correct answering of the skill testing question.
